Portfolio Collaboration Agreement
(Creative Portfolio Model Collaboration)

Please read these Terms and Conditions carefully before applying.

By submitting an application, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

If the participant is under 18 years of age, consent from a parent or legal guardian is required.

These Terms and Conditions may be amended at any time without prior notice.



1. Definitions

For the purposes of this Agreement, the following definitions apply.

Kazumi Art

Refers to the photographer and business operating under the name “Kazumi Art.”

Participant

Refers to any individual participating in a Portfolio Collaboration photo session.

Portfolio Collaboration

A complimentary photo session conducted primarily for artistic creation, portfolio development, advertising, exhibitions, social media, educational purposes, or promotional use by Kazumi Art.

This is not a commercial photography service purchased by the participant.

Delivered Images

Images selected and delivered by Kazumi Art following the collaboration.

Watermarked Images

Images containing the official Kazumi Art copyright watermark.



2. Purpose of the Collaboration

Portfolio Collaboration sessions are conducted for the purpose of creating artistic works and promotional materials for Kazumi Art.

Participation is voluntary.

No photography fee is charged to the participant in exchange for permission to use the created images for portfolio and promotional purposes.

Because the session is provided free of charge, participants acknowledge that image usage by Kazumi Art is an essential condition of participation.

Requests to withdraw permission for portfolio or promotional use after the photo session has been completed cannot be accepted.



3. Creative Direction

The photographer has full creative control over the session, including but not limited to:

• Location

• Schedule

• Styling direction

• Shooting concepts

• Posing

• Image selection

• Editing style

Participants agree to cooperate with the artistic direction of the photographer.



4. Image Delivery

Only images selected by Kazumi Art will be delivered.

Kazumi Art is under no obligation to deliver every photograph taken during the session.

Delivered images will contain an official Kazumi Art watermark.

Removal of the watermark is not permitted.

Participants wishing to obtain non-watermarked images may purchase image licensing in accordance with the pricing policy published by Kazumi Art.



5. Copyright Ownership

All photographs, videos, and other creative works produced during the collaboration remain the exclusive intellectual property and copyright of Kazumi Art.

Participation in the collaboration does not transfer any copyright ownership to the participant.

The participant receives only the limited usage rights specifically described in this Agreement.


6. Participant Usage Rights

Participants may use the delivered watermarked images for personal, non-commercial purposes only, including:

• Personal social media accounts

• Personal blogs

• Personal websites

• Personal printed materials

Tagging Kazumi Art when sharing images is greatly appreciated.

The following uses are prohibited unless prior written permission is obtained from Kazumi Art:

• Commercial use

• Advertising

• Business promotion

• Product sales

• Editorial publication

• Magazine or media publication

• Any other commercial exploitation



7. Copyright Watermark

All delivered images include the official Kazumi Art copyright watermark.

Participants may not remove, crop, cover, blur, erase, or otherwise alter the watermark.

If a participant wishes to obtain licensed non-watermarked images, they may purchase them according to the pricing policy established by Kazumi Art.



8. Image Editing Policy

To preserve the artistic integrity and creative vision of the photographer, excessive editing is prohibited.

The following adjustments are permitted:

• Minor brightness or contrast adjustments

• Standard social media filters

The following actions are prohibited:

• Cropping or changing the original composition

• Background replacement

• AI-generated editing

• AI-generated image creation

• Face replacement

• Body modification

• Beauty filters that substantially alter appearance

• Third-party editing or retouching

• Creating derivative works from all or part of the photographs

• Any edit that significantly changes the original artistic style

If you are uncertain whether an edit is acceptable, please contact Kazumi Art before publishing the image.



9. Artificial Intelligence (AI)

Delivered photographs may not be uploaded to, submitted to, processed by, or used with:

• AI image generators

• AI editing software

• AI training datasets

• Machine learning systems

• Generative AI platforms

• Any similar artificial intelligence technology

Participants may not authorize or hire any third party to perform AI editing on the photographs.

Kazumi Art reserves the right to request immediate removal of any images that violate this policy.



10. Real-Time Posting

For privacy and security reasons, participants may not publish photographs, videos, live streams, stories, or other content showing:

• The shooting location

• Behind-the-scenes activities

• Staff members

• Other participants

during the photo session.

After the session has concluded, delivered images may be shared in accordance with this Agreement.



11. Portfolio Usage

Participants acknowledge and agree that Kazumi Art may use photographs and videos created during the collaboration for:

• Portfolio presentation

• Website

• Social media

• Exhibitions

• Competitions

• Printed materials

• Advertising

• Educational presentations

• Promotional campaigns

Permission for these uses is an essential condition of participation in the Portfolio Collaboration.

Such permission cannot be withdrawn after the photo session has been completed.


12. Health and Safety

Participants are responsible for ensuring that they are physically and mentally able to participate in the session safely.

Kazumi Art reserves the right to refuse or discontinue the session if participation is considered unsafe.

Participants must disclose in advance any relevant medical conditions, allergies, injuries, or medications that may affect the session.

For overseas sessions, participants are required to obtain appropriate travel insurance.



13. Personal Belongings

Participants are solely responsible for their personal belongings during the session.

Kazumi Art accepts no responsibility for loss, theft, or damage to personal property.



14. Travel and Expenses

Participants are responsible for all transportation costs, accommodation expenses, admission fees, and any other personal expenses unless otherwise agreed in writing.

Kazumi Art is not responsible for any accidents or incidents occurring while traveling to or from the session location.



15. Participant Conduct

Kazumi Art reserves the right to immediately terminate the session if a participant engages in:

• Violence

• Harassment

• Defamation

• Discrimination

• Illegal activities

• Behavior that threatens the safety or comfort of others

• Conduct that damages the reputation or creative work of Kazumi Art

No compensation shall be provided if participation is terminated for these reasons.



16. Limitation of Liability

Kazumi Art shall not be liable for delays, cancellations, or failure to perform services caused by events beyond reasonable control, including but not limited to:

• Natural disasters

• Extreme weather

• War

• Civil unrest

• Government restrictions

• Transportation disruptions

• Epidemics or pandemics

• Other force majeure events

Except where required by applicable law, Kazumi Art’s liability shall be limited to the maximum extent permitted by law.



17. Privacy

Personal information collected during the application process will be used only for:

• Managing Portfolio Collaboration applications

• Contacting participants regarding the session

• Operating and administering Kazumi Art services

Personal information will not be disclosed to third parties except where required by law or with the participant’s consent.



18. Entire Agreement

These Terms and Conditions constitute the entire agreement between Kazumi Art and the participant regarding the Portfolio Collaboration.

If any provision is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

Failure by Kazumi Art to enforce any provision shall not constitute a waiver of that provision.




Thank you for your interest in participating in a Portfolio Collaboration with Kazumi Art.

These collaborations are made possible through the generosity, trust, and cooperation of our participants.

Our goal is to create timeless artistic images while providing a respectful, safe, and enjoyable experience for everyone involved.

We sincerely appreciate your understanding of these Terms and Conditions and look forward to creating beautiful work together.



Privacy Notice

Personal information provided through this application will be used solely for the following purposes:

• Managing your application

• Contacting you regarding the collaboration

• Administrative purposes directly related to Kazumi Art services

By submitting your application, you acknowledge that you have read and agreed to these Terms and Conditions.
