Please read these Terms and Conditions carefully before booking a photo shoot with Kazumi Art.

By making a booking, you acknowledge and agree to these Terms and Conditions.

If the participant is under 18 years of age, parental or legal guardian consent is required.

These Terms and Conditions may be amended without prior notice.

 Terms and Conditions

1. About the Photo Shoot

1-1) Edited photographs and videos will be delivered electronically to the email address registered by the client.

DVDs, photo prints, albums, and other products are available at an additional cost.

Prices are subject to change without notice.

1-2) Additional photo retouching requests may incur extra charges.

1-3) Video editing services may incur additional charges.

1-4) The client must review the delivered files within 7 days of receipt and notify us of any issues.

If no notification is received within 7 days, delivery shall be deemed accepted.

Clients are responsible for backing up and storing their own files.

We will retain your delivered files for 30 days after delivery. After this period, data storage is not guaranteed.

1-5) If photography requires permits, location fees, permissions, licenses, or approvals from third parties, the client is responsible for obtaining and paying for them.

1-6) Kazumi Art retains the copyright to all photographs and videos created during the session.

Photographs may be used for our website, social media, advertisements, printed materials, portfolio, exhibitions, and other promotional purposes.

If you do not wish your images to be used, please notify us before the photo shoot.

Reasonable care will be taken to protect personal information and privacy.

1-7) Clients are welcome to share delivered photographs on social media, blogs, and personal websites.

Tagging our account or providing photo credit is greatly appreciated but not required.

Any use that is unlawful, offensive, defamatory, or harmful to our reputation is prohibited.

1-8) To preserve the artistic style, color grading, and creative vision of the photographer, excessive editing of delivered photographs is prohibited.

The following adjustments are permitted:

• Minor brightness and contrast adjustments

• Standard social media filters

• Minor retouching of personal facial concerns

The following actions are prohibited:

• AI-generated modifications, transformations, or edits

• Editing, retouching, or modification by third parties

• Creating new works using all or part of the photographs

• Cropping or altering the original composition

• Background replacement

• Significant alteration of subjects or individuals

• Commercial use involving edited images

• Any modification that substantially changes the artistic intent of the original work

If you are unsure whether a modification is permitted, please contact us in advance.

AI Usage Policy

Photographs delivered by Kazumi Art may not be uploaded to, submitted to, processed by, or used with AI training systems, AI image generators, AI editing tools, or similar technologies.

Clients may not authorize or commission third parties to perform AI-based modifications.

If images edited in violation of these Terms are publicly shared, Kazumi Art reserves the right to request their removal.

2. Payment

A minimum deposit of 50% is required to secure a booking.

The remaining balance must be paid in cash on the day of the photo shoot.

For overseas photo shoots, full payment is required at the time of booking.

3. Cancellation Policy

If the client cancels the booking, the following cancellation fees apply:

• From booking until 61 days before the scheduled date: 30%

• 60 to 8 days before the scheduled date: 50%

• 7 days before the scheduled date or later: 100%

Cancellation fee instructions will be sent by email.

Any bank transfer fees are the responsibility of the client.

4. Photographer Cancellation

If we must cancel the service due to circumstances on our side, all payments received will be refunded.

No additional compensation will be provided.

No refunds will be issued after the photo shoot has taken place.

5. Force Majeure

Kazumi Art shall not be liable for failure to perform services due to events beyond our reasonable control, including but not limited to natural disasters, earthquakes, typhoons, tsunamis, war, riots, strikes, transportation disruptions, governmental actions, or other force majeure events.

6. Health and Safety

Kazumi Art is not responsible for any accidents, injuries, illnesses, or damages occurring during participation in the service.

Participants in overseas photo shoots are required to obtain appropriate travel insurance.

7. Health Conditions

We reserve the right to decline a booking if we determine that a participant’s physical or mental condition may prevent the safe provision of services.

8. Medical Conditions

If you have any medical condition, allergies, chronic illness, skin condition, or are taking medication, please inform us in advance.

Participants are responsible for managing their own health conditions and any related risks.

9. Personal Belongings

Clients are responsible for safeguarding their own valuables and personal belongings.

Kazumi Art accepts no responsibility for theft, loss, or damage.

10. Transportation

Travel expenses are the responsibility of the client.

Kazumi Art is not responsible for any accidents or incidents occurring while traveling to or from the photo shoot location.

11. Additional Expenses

Any expenses not specifically stated as included in the service are the responsibility of the client.

12. Conduct

Kazumi Art reserves the right to immediately terminate the service without refund in cases involving violence, harassment, defamation, abusive conduct, or other unacceptable behavior.

13. Privacy and Real-Time Posting

During the photo shoot, clients may not publicly share photographs, videos, live streams, or other content showing the shoot location, participants, staff members, or behind-the-scenes activities through social media, the internet, or any media platform.

This policy exists to protect privacy, personal safety, security, and to prevent disclosure of real-time locations and schedules.

Delivered photographs may be shared in accordance with Sections 1-7 and 1-8.

We appreciate your understanding and cooperation in helping maintain a safe environment for everyone.

14. Client Disputes

Any disputes between clients or participants must be resolved by the parties involved.

Kazumi Art accepts no responsibility for such disputes.

15. Subcontracting

Kazumi Art may subcontract all or part of the services to third parties when necessary.

16. Termination

Kazumi Art reserves the right to terminate services immediately without prior notice if:

• The client violates these Terms and Conditions

• The client engages in conduct that may harm Kazumi Art or others

• The client becomes involved in fraudulent or unlawful activity

• The client is found to be associated with organized crime or similar criminal organizations

17. Third-Party Services

Kazumi Art provides photography services only.

Kazumi Art is not responsible for the content, quality, condition, suitability, or outcome of any clothing, costumes, hair and makeup services, accessories, venues, or other products and services provided by third parties.

Requests, complaints, refunds, or claims relating to such third-party products or services cannot be handled by Kazumi Art.
